owned and operated by the First Presbyterian Church ("FPC") of
Morristown, Tennessee. This Agreement contains the terms and conditions
(the "Terms and Conditions") upon which you may access and use this

By accessing or using this Site, you indicate that you understand
and intend these Terms and Conditions to be the legal equivalent of a
signed, written contract and that you agree to be bound by them. Please
note that FPC reserves the right to change these Terms and Conditions
(effective immediately upon notice published at this Site) and your
further use of this Site following any such change indicates that you

- Limited License. This Agreement provides you with a personal,
revocable, nonexclusive, nontransferable license to use this Site as
long as you continue to comply with these Terms and Conditions. You may

be construed and enforced in accordance with Tennessee law. Any action
to enforce this Agreement will be brought in the federal or state courts
in Nashville, Tennessee U.S., and all parties to this Agreement are
subject to the jurisdiction of such courts. This Site is controlled and
operated by FPC from its offices within the United States.
- Term and Termination. This Agreement will take effect
when you begin using this Site (indicating your acceptance of these
Terms and Conditions). FPC reserves the right at any time and for any
reason to deny you access to the Site or any portion thereof, and to
terminate this Agreement. Termination will be effective without notice.
- Waiver. Failure to insist on strict performance of any
of the Terms and Conditions of this Agreement will not waive any
subsequent default or any other right or provision at any other time.
- Severability. If a court determines that any part of
these Terms and Conditions is invalid or unenforceable pursuant to
applicable law including, but not limited to, the warranty disclaimers
and the liability limitations set forth above, then the invalid or
unenforceable provision will be deemed superseded by a valid,
enforceable provision that FPC will provide that most clearly matches
the intent of the original provision. The remainder of these Terms and
Conditions shall continue in effect.
- Relationship. No joint venture, partnership, employment,
or agency relationship exists between you and FPC as a result of this
Agreement or your use of this Site.
Entire Agreement / Reservation of Rights. These Terms and Conditions
and FPC's Privacy Policy, which this Agreement incorporates by
reference, represents the entire agreement between you and FPC with
respect to your use of and material available on or through this Site.
Any rights not expressly granted in this Agreement are reserved.
